One of the difficulty of warez (and the MP3 or porn) is the difficulty in creating and maintaining websites for downloading these programs. The problem is that most people try to create sites full of links that point to other sites, a process called leeching. The people that create the linking sites want to earn money from advertising (often porn ads), but they don't want to pay for the bandwidth needed for people to actually download the files.
This results in the situation where if you are looking for illegal software, you'll get and endless run-around from leech sites with bad links. If you try to host illegal software, your site immediately becomes inundated with traffic. Likewise, a favorite denial-of-service attack is to post to newgroups links to the victim's website, and claim they are warez/mp3/porn.
